These Terms of Service ("Terms") govern your use of the Zingly platform and services, including the website https://zingly.com.au and the app at https://app.zingly.com.au ("Zingly", "we", "us"). By using Zingly, you agree to these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account or accessing the Zingly platform, you agree to be bound by these Terms and all applicable laws and regulations. You must be at least 18 years old to use Zingly.

2. Accounts and Access

You are responsible for maintaining the confidentiality of your login credentials. You agree to provide accurate and complete information and to keep it up to date. Social login tokens from Google or Facebook may be used for authentication but are not stored.

3. Plans and Pricing

Zingly offers a free plan and a paid plan at AU$29.99/month. Billing is handled via Stripe (https://stripe.com). Paid plans automatically renew unless cancelled. Refunds are not provided except as required by law.

4. Permitted Use and Restrictions

You may use Zingly only for lawful purposes. You agree not to use the platform to:

  • Generate or distribute sexually explicit, abusive, or illegal content
  • Harass or harm others
  • Post unauthorized or misleading marketing content
  • Reverse-engineer or disrupt the platform

Zingly reserves the right to suspend or terminate accounts that violate these restrictions.

5. API Integration and Consent

By connecting your social media accounts, you authorize Zingly to post and schedule content on your behalf via Meta (Facebook and Instagram) APIs. Zingly does not store access tokens from social platforms.

6. Intellectual Property

All rights to the Zingly platform, including code, branding, and content templates, are owned by Zingly Pty Ltd. Users retain ownership of content they upload or create using the platform.

7. Termination

You may cancel your account at any time. Zingly may suspend or terminate access to the platform for violation of these Terms or for operational reasons.

8. Limitation of Liability

To the fullest extent permitted by law, Zingly is not liable for any indirect, incidental, or consequential damages, including but not limited to data loss, service interruption, or third-party platform changes.

9. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria.
